JUDGMENT

[1] This is an application for inscription of judgment against the co-defendant, Jean Lafleur Communications Marketing Inc. for failure to appear.

[2] WHEREAS on March 11, 2005, the Attorney General of Canada instituted legal proceedings against several defendants, including the co-defendant, Jean Lafleur Communications Marketing Inc., against which an award in the amount of $879,744.00 is sought;

[3] WHEREAS prior to said action, the co-defendant, Jean Lafleur Communications Marketing Inc. itself filed an action against the Attorney General of Canada in the amount of $197,350.63, as shown more fully in court file number 500-17-014122-033 of the Superior Court of the District of Montreal;

[4] WHEREAS on August 19, 2005, Jean Lafleur Communications Marketing Inc. filed an assignment of property with the trustee Wasserman Stotland Bratt Grossbaum & Pinsky Inc., as shown in court file number 500-11-026323-051 of the Superior Court, Commercial Division, of the District of Montreal;

[5] WHEREAS, by order issued on October 3, 2007, by the Registrar in Bankruptcy, Chantal Flamand, the Attorney General of Canada was authorized to continue the civil proceedings already instituted against the co-defendant in the present case;

[6] WHEREAS the affidavit of Myra Conway acknowledges that the Attorney General of Canada owes the amount of $183,180.00 in respect of the claim contained in 500-17-014122-033;

[7] WHEREAS the trustee in bankruptcy Murray Pinsky acquiesces to the application;

FOR THESE REASONS:

GRANTS this application against Jean Lafleur Communications Marketing Inc.;

EFFECTS a set-off between the amount claimed in this action and the amount of $183,180.00 following the partial acknowledgement of the amount claimed by the co-defendant against the plaintiff in court file number 500-17-014122-033;

AND, THEREFORE,

ORDERS the co-defendant, Jean Lafleur Communications Marketing Inc. to pay to the plaintiff the amount of $696,564.00, with interest since the summons;

ORDERS that a copy of the present judgment be filed in 500-17-014122-033;

Without costs.
