Amendments to the Departmental Consolidation of the Customs Tariff

1. The Canada Border Services Agency (CBSA) wishes to advise of a further amendment to the April 1, 2013 version of the Departmental Consolidation of the Customs Tariff (Tariff).

2. Tariff item 6506.10.10 has been amended to add a provision for “Other protective headgear, athletic”, which are goods that were previously classified in 6506.10.90 (“Other”).

3. Consequently, Statistics Canada has replaced classification numbers 6506.10.90.10 and 6506.10.90.90 with 6506.10.90.00, and has created a new classification number, 6506.10.10.40 (“Protective headgear, athletic”). An amended version of the Departmental Consolidation of the Customs Tariff, reflecting all of these changes, will be posted on the Canada Border Services Agency Web site.

4. As a result of this amendment, importers of protective athletic headgear may be eligible for a refund of the duties paid on importations made since April 1, 2013. Refund claims are to be made in accordance with the provisions of section 74 of the Customs Act, using a Form B2, Canada Customs — Adjustment Request.

5. For certainty regarding the tariff classification of a product, importers may request an advance ruling on tariff classification. Details on how to make such a request can be found in CBSA Memorandum D11-11-3, Advance Rulings for Tariff Classification, which is found on the CBSA Web site.
