Document Delivery: Copyright at NRC-CISTI

Documents supplied by NRC-CISTI's Document Delivery service are copyright-cleared. As a publisher, online service vendor, and document provider, NRC-CISTI is concerned about and respects copyright in all aspects of the information life cycle. Agreements are in place to ensure that the rights of authors and publishers are recognized whenever NRC-CISTI provides a document from its collection or from other sources.


Copyright at NRC-CISTI

NRC-CISTI supports intellectual property rights and has made significant efforts to ensure compliance with appropriate national laws and international conventions. NRC-CISTI has negotiated agreements with copyright collectives and publishers to extend document delivery service options. NRC-CISTI maintains a copyright system that ensures accurate and up-to-date application of copyright.

Copyright Agreements

All copies provided by NRC-CISTI's Document Delivery services are copyright-cleared. Depending on the service and the client's location, a copyright fee may be charged in addition to the supply fee. Copies from NRC-CISTI's Direct service and Custom services are covered by copyright agreements with Access Copyright and COPIBEC, with Access Copyright with the US Copyright Clearance Center, and directly with publishers.

NRC-CISTI Clients

  • Canadian Clients

    In general, this means that Canadian clients who are non-exempt will be charged copyright fees for most documents. Canadian clients who are exempt will be charged copyright fees for only a few publishers, or if they have their documents delivered via Secure Desktop Delivery.

    Non-exempt Canadian clients ordering documents from NRC-CISTI are charged any applicable copyright fees. Royalty payments are $4 for articles up to seven pages and $8 for articles of eight pages or more. Royalties are higher for documents delivered via Secure Desktop Delivery. Please consult the Copyright Act for further information about exception regulations. The Copyright Act is available on the Internet at: http://laws.justice.gc.ca/en/C-42/

  • US and International Clients

    Clients outside Canada will be charged the US Copyright Clearance Center rate or the direct publisher's copyright agreement fee, when applicable.

NRC-CISTI Document Delivery Services

For the Extended Supply Service, NRC-CISTI passes on the copyright fee charged by the supplier to all clients. For On-site - Photocopying on NRC premises, copying is covered by the Canadian Copyright Act and by copyright agreements with Access Copyright and COPIBEC.


Frequently Asked Questions

Question: When I receive a copy from NRC-CISTI, may I re-copy and re-distribute it?

Answer: No. Each copy provided by NRC-CISTI is copyright-cleared for the use of one client only. These copies may not be re-copied or re-distributed. If you are an intermediary who places orders for others, you may receive the copy from NRC-CISTI and forward that same paper copy to the user, since you are not using the article yourself.

Question: Can I order multiple copies from NRC-CISTI?

Answer: To order multiple copies of a single document, you will need to place an order for each copy to ensure that each one is copyright cleared. For large orders, please consult the publisher to arrange for permission.

Question: Does NRC-CISTI charge a flat-rate copyright fee?

Answer: No. NRC-CISTI charges the copyright fee that is established by the publisher or collective.

Question: How can I find out the copyright amount before ordering a document?

Answer: Find the document that you want to order on NRC-CISTI's Online Catalogue and click on "order this item". Then click on the "copyright charges" button at the bottom of the order form. If you are a subscriber to NRC-CISTI Source, you can check the copyright fee by clicking on the "copyright charges" button on the order form.

Question: In the US, the fair use clause allows me to obtain a limited number of copies of articles without paying copyright in certain cases. Does NRC-CISTI provide uncleared copies to US clients under the fair use clause?

Answer: No. As a Canadian organization, NRC-CISTI cannot provide uncleared copies under the US fair use clause.

Question: I already have an agreement with the CCC. Will NRC-CISTI supply uncleared documents to me under my own agreement with the CCC?

Answer: No. Check the wording of your agreement with the CCC. Normally the agreement covers only the copying done within your own organization. Since the copies NRC-CISTI provides to you are copied at NRC-CISTI, they are not covered by your agreement, and copyright must be collected by NRC-CISTI.

Question: Can I set a limit on how much I'm willing to pay for a document?

Answer: Yes. If you don't want to verify the copyright amount through the NRC-CISTI Online Catalogue or NRC-CISTI Source, you may set a Maximum Cost in your document order. For example, if you are not willing to pay more than $30 for a document, enter $30 in the Maximum Cost field. If the total (supply fee and copyright amount) exceeds your maximum cost, your order will be cancelled. Another alternative is to set a price limit per document for your NRC-CISTI account number. Note that if you set a price limit in your account, you will not be able to over-ride it on an order-by-order basis.
