First steps

If you are considering requesting a Ministerial or President's Review (undertaken by delegated CBSA officials), you first need to determine if the Agency actually took a formal action or made a decision in relation to you or your goods. Then you need to see just what took place and what you need to do to request a review.

You may find it more convenient to see if you received a form or letter from the CBSA. If you were provided with a form or letter, then the CBSA did make a decision and take action relating to the entry of your goods into Canada — and you can request a review.

The following tables show the various forms and letters related to CBSA enforcement actions and trade decisions for both individual travellers entering Canada and for commercial goods crossing our border and the associated actions taken.

Forms/Letters

Individual Traveller

 Examples of Actions Taken by the CBSA

 Form or Letter

  • Your goods were seized.
  • You paid duties and taxes.
  • You paid a monetary penalty.
  • Your currency or monetary instruments were seized.
  • Your Trusted Traveller membership was rejected, cancelled or suspended.

A letter from the CBSA stating that your application for the following Trusted Traveller programs has been rejected or membership has been cancelled or suspended:

  • Your goods were prohibited from entering Canada.
  • You disagree with an advance ruling.

 

Commercial

Examples of Decisions Made by the CBSA

 Form or Letter

  • Your goods were seized.
  • You paid a monetary penalty.
  • You disagree with the origin, tariff classification, value for duty or marking of imported goods.
    You disagree with an advance ruling.
  • Your goods were prohibited from entering Canada.
  • You disagree with an advance ruling.
